Terms of Use

  • 1. Introduction

Welcome to Pawsibly Yours. By accessing or using the Pawsibly Yours mobile application (the “App”) or any related services (collectively, the “Services”), you agree to be bound by these Terms of Use (“Terms” or “Agreement”). Please read these Terms carefully before creating an account or using the Services.

The Services are operated by Pawsibly Yours, LLC, a Missouri limited liability company (“Pawsibly Yours,” “we,” “us,” or “our”).

Pawsibly Yours is a mobile-based pet adoption matching platform that connects prospective adopters with dogs available through partner rescue organizations and approved private rehoming listings. The App uses a compatibility matching system and integrates with third-party rescue databases, including Rescue Groups, Inc., to surface available dogs based on your profile, lifestyle, and questionnaire responses.

DISPUTE RESOLUTION: PLEASE REVIEW SECTION 15 CAREFULLY. DISPUTES BETWEEN YOU AND PAWSIBLY YOURS WILL BE RESOLVED THROUGH BINDING ARBITRATION, WITH LIMITED EXCEPTIONS. SECTION 15 INCLUDES CLASS ACTION AND JURY TRIAL WAIVERS.

We may update these Terms from time to time. We will post the updated Terms with a revised effective date. Your continued use of the Services after the effective date of any change constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Services.

  • 2. Eligibility and Account Responsibilities
2a. Eligibility

You must meet all of the following requirements to use the Services. By using the Services, you represent and warrant that:

  • You are at least 18 years of age;
  • You are an individual (not a corporation, partnership, or other business entity), unless accessing the Services as an authorized representative of a registered rescue organization;
  • You are legally permitted to enter into a binding contract;
  • You are not prohibited by applicable law from using the Services;
  • You do not have more than one active account on the Services; and
  • You have not been previously removed from the Services by us, unless you have our express written permission to create a new account.
2b. Account Creation

To use certain features of the Services, you must create an account. When creating your account, you agree to provide accurate and complete information, including:

  • Your full name;
  • A valid email address; and
  • Biographical information and lifestyle details as prompted during account setup.

You will also be asked to complete the Adopter Lifestyle and Compatibility Quiz (the “Quiz”). The information you provide in the Quiz, including your home type, household composition, activity level, experience with dogs, and lifestyle preferences, will be processed by our AI-powered compatibility matching system to generate a “Your Vibe” profile and to rank and filter available dogs based on compatibility. You are responsible for providing truthful, complete answers and for keeping your account information accurate and up to date.

2c. Account Termination and Data Deletion

You may delete your account at any time through the App settings. Upon deletion, we will remove your personal data from our active systems within 30 days, subject to our data retention obligations and the terms of our Privacy Policy.

2d. Your Responsibilities

You agree to:

  1. Use the Services only for their intended purpose of finding dogs available for adoption;
  2. Provide truthful and accurate information in your profile, Quiz responses, and any other communications through the Services;
  3. Comply with all applicable laws in connection with your use of the Services;
  4. Treat all other users, rehomers, and rescue organizations with courtesy and respect; and
  5. Take reasonable steps to protect your account credentials.
2e. Prohibited Conduct

You agree that you will not:

  1. Misrepresent your identity, age, qualifications, or household composition in your profile or Quiz responses;
  2. Use the Services for any purpose other than lawful pet adoption;
  3. Attempt to contact, harass, or solicit other users outside the App;
  4. Submit false, misleading, or fraudulent information in any listing, profile, or questionnaire;
  5. Use the Services to solicit money or items of value from other users;
  6. Post or share any Prohibited Content (see Section 3d);
  7. Use any automated tools, bots, scrapers, or similar means to access or extract data from the Services;
  8. Attempt to circumvent or interfere with the Services, our compatibility systems, or our infrastructure;
  9. Use the Services in connection with any commercial activity not authorized by us; or
  10. Create a new account after we have suspended or terminated your account, unless we give you express written permission to do so.
  • 3. Content
3a. Your Content

You may upload photos and other content to the Services (“Your Content”). You are solely responsible for Your Content and represent that you have all rights necessary to upload and share it. You grant Pawsibly Yours a non-exclusive, worldwide, royalty-free license to use, display, store, and reproduce Your Content for the purpose of operating and improving the Services.

We reserve the right to remove Your Content at any time if we determine, in our sole discretion, that it violates these Terms or is otherwise objectionable.

3b. Dog Listings and Rescue Content

Dog listings on the Services are sourced from Rescue Groups, Inc. and other integrated third-party rescue databases, as well as approved private rehoming submissions (see Section 4). We do not independently verify the accuracy, completeness, or reliability of any listing, including information about a dog’s health, temperament, breed, age, or history. Listing information is displayed as provided by the originating rescue organization or private rehomer.

ALL DOG LISTINGS ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. PAWSIBLY YOURS MAKES NO WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE ACCURACY OF ANY LISTING OR THE CONDITION, HEALTH, BEHAVIOR, OR SUITABILITY OF ANY DOG FEATURED ON THE SERVICES.

When a dog is adopted and the listing is updated through our third-party API integration, the listing will be automatically removed from the Services. Users who have saved a dog to their favorites may receive an email notification when that dog’s listing is removed.

3c. AI-Powered Compatibility Matching

The Services use an artificial intelligence compatibility system to rank and filter available dogs based on your Quiz responses.

COMPATIBILITY SCORES AND MATCHING RESULTS ARE PROVIDED FOR INFORMATIONAL AND CONVENIENCE PURPOSES ONLY AND ARE NOT GUARANTEES OF SUITABILITY. THE AI MATCHING SYSTEM IS BASED ON SELF-REPORTED INFORMATION AND AUTOMATED PARSING OF DOG BIO TEXT. PAWSIBLY YOURS EXPRESSLY DISCLAIMS ANY LIABILITY FOR THE ACCURACY OR OUTCOMES OF ANY AI-GENERATED COMPATIBILITY SCORE, RECOMMENDATION, OR MATCH.

3d. Prohibited Content

You may not upload, post, or share any content that:

  1. Is false, fraudulent, misleading, or misrepresents the identity or condition of a dog;
  2. Is obscene, offensive, harassing, threatening, or discriminatory;
  3. Violates any applicable law, including animal cruelty laws;
  4. Promotes the sale, trade, or commercial exchange of dogs (as distinguished from lawful adoption);
  5. Includes personal contact information intended to solicit off-platform transactions;
  6. Infringes any third-party intellectual property or privacy rights; or
  7. Contains malware, viruses, or other harmful code.
  • 4. Rehome Support (“RePaw” Listings)
4a. Overview

The Services offer a private rehoming feature called Rehome Support (identified in the App by the “RePaw” designation) through which individuals may list a dog they personally own or care for. Rehome Support listings are separate from rescue organization listings and are labeled “Verified Rehome” within the App. Rehome Support is not a subscription feature and is subject to a separate listing fee and approval process.

4b. Eligibility to List

To submit a Rehome Support listing, you must confirm that all of the following are true:

  • You are the current legal owner or authorized caretaker of the dog;
  • The dog currently lives with you;
  • The dog was not bred, purchased, or acquired for resale;
  • The dog is not part of a litter;
  • You are not a breeder, broker, pet store, or reseller;
  • You are not posting multiple dogs simultaneously;
  • You are not seeking to profit from the rehoming; and
  • You agree that Pawsibly Yours may remove the listing at any time in its sole discretion.

Dogs under six (6) months of age are not eligible for Rehome Support listing and will be automatically blocked from submission.

4c. Required Information and Uploads

To submit a Rehome Support listing, you must provide the following information:

  • Your first and last name;
  • Email address and phone number;
  • The dog’s name, age, and breed or best-guess breed;
  • Microchip status and vaccination status;
  • Spay/neuter status;
  • Reason for rehoming;
  • Whether you are requesting a rehoming fee from the adopter (maximum $150);
  • Compatibility information: good with dogs, cats, and/or children;
  • Whether the dog has medical needs or special behavior needs;
  • Whether the dog is house-trained;
  • Your preferred contact method (phone, email, or social media);
  • A clear, current photograph of the dog; and
  • Any other information that we reasonably request.

You must also upload a copy of a valid government-issued photo ID and a signed rehoming agreement (provided by Pawsibly Yours). Submissions that do not include all required information and documents will not be reviewed.

4d. Listing Fee and Rehoming Fee

A non-refundable fee may be required at the time of submission. This fee covers the cost of reviewing your application and does not guarantee listing approval. If a rehoming fee is requested, the fee is paid directly from the adopter to you and is not processed through Pawsibly Yours.

4e. Approval and Removal

All Rehome Support submissions are subject to review and approval by Pawsibly Yours. We reserve the right to reject any submission or remove any active listing at any time for any reason, including if we determine that the listing violates these Terms or our content standards. Approval of a listing does not constitute an endorsement of the accuracy of the information provided or the condition of the dog.

  • 5. Subscriptions and Payments
5a. Billing and Cancellation

Subscriptions are billed through and managed by the Apple App Store or Google Play Store, as applicable. By purchasing a subscription, you agree to the applicable platform’s terms and authorize the platform to charge your payment method on a recurring basis at the selected subscription rate. Pawsibly Yours does not process subscription payments directly. Cancellation and refund requests must be submitted through the applicable platform in accordance with its policies.

5b. Advertising

The Services may display advertising. Advertisers do not have access to your personally identifiable information. We may share aggregated, anonymized demographic data with advertisers for the purpose of delivering relevant advertising.

  • 6. Privacy and Data Collection

Your privacy is important to us. Our Privacy Policy, incorporated into these Terms by reference, describes how we collect, use, store, and share your personal information. By using the Services, you consent to the data practices described in our Privacy Policy.

The following is a summary of key data practices:

  • We collect your name, email address, biographical information, and Quiz responses, including lifestyle preferences, household composition, and activity level;
  • We collect location data, including GPS information, when you use the Services. You may set a home location and a search radius within the App, and the App may recognize when you are outside your home area;
  • We use Google Analytics and similar services to understand how users interact with the Services;
  • Email Marketing Consent. By creating an account, you expressly agree to receive marketing emails, promotional communications, and service-related updates from Pawsibly Yours. You may opt out of marketing emails at any time by using the unsubscribe link included in those emails;
  • We share anonymized, aggregated demographic information with advertisers, but we do not sell your personally identifiable information; and
  • If you delete your account, we will remove your personal data from our active systems within 30 days, subject to our legal obligations.
6a. California Residents — California Consumer Privacy Act (CCPA)

If you are a resident of California, you have specific rights under the California Consumer Privacy Act of 2018, as amended by the California Privacy Rights Act of 2020 (collectively, “CCPA”). This section supplements our Privacy Policy and applies solely to California residents.

Categories of Personal Information We Collect. In the preceding 12 months, we have collected the following categories of personal information from users:

  • Identifiers, such as your name and email address;
  • Personal records information, such as your phone number (if provided in connection with a Rehome Support listing);
  • Characteristics of protected classifications, such as inferences about your household composition and lifestyle drawn from your Quiz responses;
  • Internet or other electronic network activity information, such as browsing activity within the App and interaction data collected through Google Analytics;
  • Geolocation data, such as your home location, search radius, and GPS location when using the App; and
  • Inferences drawn from the above to create a profile about your preferences and compatibility with available dogs.

Purposes for Collection. We collect the categories of personal information listed above for the following business purposes: operating and improving the Services, providing and personalizing the AI-powered matching system, displaying relevant advertising, communicating with you about the Services, and complying with legal obligations.

Sale and Sharing of Personal Information. We do not sell your personal information. We share anonymized, aggregated demographic data with advertising partners, which does not constitute a “sale” or “sharing” under the CCPA. We do not share personally identifiable information with advertisers.

Your Rights as a California Resident. Subject to applicable law and certain exceptions, California residents have the following rights with respect to their personal information:

  • Right to Know: You have the right to request that we disclose the categories and specific pieces of personal information we have collected about you, the categories of sources from which we collected it, the business or commercial purpose for collecting it, and the categories of third parties with whom we share it.
  • Right to Delete: You have the right to request that we delete personal information we have collected from you, subject to certain exceptions.
  • Right to Correct: You have the right to request that we correct inaccurate personal information we maintain about you.
  • Right to Opt Out of Sale or Sharing: We do not sell or share your personally identifiable information. If our practices change, we will update this section and provide a mechanism to opt out.
  • Right to Non-Discrimination: We will not discriminate against you for exercising your CCPA rights.

How to Submit a Request. To submit a CCPA rights request, please contact us at support@pawsiblyyoursapp.com or by mail at the address listed in Section 16. We will respond to verifiable requests within the timeframe required by applicable law. We may need to verify your identity before processing your request.

Authorized Agents. You may designate an authorized agent to submit a CCPA request on your behalf. To do so, the agent must provide written authorization signed by you, and we may verify your identity directly with you before processing the request.

  • 7. Intellectual Property

All content on the Services that is not Your Content or third-party listing content (including the App design, graphics, text, algorithms, compatibility matching system, and branding) is owned by or licensed to Pawsibly Yours, LLC and is protected by applicable intellectual property laws. You may not copy, reproduce, modify, distribute, or create derivative works from any such content without our prior written consent.

We grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the Services for your own personal, non-commercial, adoption-related purposes, subject to these Terms. This license is automatically revoked if you violate these Terms.

  • 8. Third-Party Services and Links

The Services integrate with third-party platforms and databases, including Rescue Groups, Inc. and adoption portals operated by partner rescue organizations. When you click through to an adoption portal or other third-party site, you are leaving the Services and your interactions on that site are governed by that site’s own terms and privacy policy. Pawsibly Yours is not responsible for the content, practices, or policies of any third-party site or service.

The Services also use Google Analytics and may incorporate other third-party SDKs. Your use of the Services is subject to those third parties’ applicable terms as they relate to data they collect.

  • 9. Disclaimer of Warranties

THE SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. PAWSIBLY YOURS EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

PAWSIBLY YOURS DOES NOT WARRANT THAT: (A) THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE; (B) ANY DOG LISTING IS ACCURATE, COMPLETE, OR CURRENT; (C) ANY COMPATIBILITY SCORE, MATCH RESULT, OR AI-GENERATED RECOMMENDATION IS RELIABLE OR APPROPRIATE FOR YOUR CIRCUMSTANCES; OR (D) ANY DOG FEATURED ON THE SERVICES WILL BE AVAILABLE FOR ADOPTION AT THE TIME OF YOUR INQUIRY.

  • 10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PAWSIBLY YOURS, LLC AND ITS MEMBERS, MANAGERS, EMPLOYEES, AGENTS, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES, INCLUDING BUT NOT LIMITED TO:

  • Any harm caused by a dog you adopt or encounter through the Services;
  • The accuracy, reliability, or legality of any listing;
  • The accuracy or outcomes of any AI-generated compatibility score or match recommendation;
  • Any interaction between you and a rescue organization, shelter, or private rehomer; or
  • Any loss of data or account access.

IN NO EVENT WILL OUR TOTAL LIABILITY TO YOU EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO PAWSIBLY YOURS FOR THE SERVICES IN THE THREE MONTHS PRECEDING THE CLAIM OR (B) $100.

  • 11. Indemnification

You agree to indemnify, defend, and hold harmless Pawsibly Yours, LLC and its members, managers, employees, agents, and licensors from and against any claims, losses, liabilities, damages, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Services; (b) Your Content; (c) your violation of these Terms; or (d) your violation of any applicable law or third-party right.

  • 12. Account Suspension and Termination

Pawsibly Yours reserves the right to suspend or terminate your account, without notice or liability, if we determine in our sole discretion that you have violated these Terms, misused the Services, submitted false or fraudulent information in a listing or Quiz, or for any other reason that we determine warrants suspension or termination. We may also terminate accounts that are inactive for an extended period.

Upon termination, your license to use the Services is immediately revoked. Sections of these Terms that by their nature should survive termination will survive.

 

  • 13. Modifications to the Services

We reserve the right to modify, suspend, or discontinue any part of the Services at any time, including subscription features and compatibility matching functionality, without notice or liability. We may also introduce mandatory features that affect your access to the App. If you do not wish to use a mandatory feature, you may close your account.

  • 14. Reporting and Moderation

Pawsibly Yours reserves the right to investigate and take action, in its sole discretion, against any user or listing that violates these Terms. This includes removing content, suspending or terminating accounts, and reporting conduct to appropriate authorities where required by law.

If you believe a listing or user profile contains inaccurate, fraudulent, or otherwise objectionable content, please contact us at support@pawsiblyyoursapp.com. We do not guarantee any particular response time or outcome.

  • 15. Dispute Resolution; Arbitration

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.

Informal Resolution. Before initiating arbitration, you agree to contact us at support@pawsiblyyoursapp.com and provide a written description of the dispute, including the relief you seek. We will attempt to resolve the dispute informally within 30 days of receiving your notice.

Binding Arbitration. If we cannot resolve the dispute informally, both parties agree to submit the dispute to binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration will be conducted on an individual basis in Missouri or, at your election, by videoconference or telephone. The arbitrator’s decision will be final and binding and may be entered as a judgment in any court of competent jurisdiction.

Exceptions. The following disputes are excluded from arbitration and may be brought in court: (a) disputes eligible for small claims court; and (b) claims for injunctive or other equitable relief related to intellectual property infringement.

 

Class Action Waiver. YOU AND PAWSIBLY YOURS WAIVE THE RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION. ALL DISPUTES MUST BE BROUGHT IN YOUR INDIVIDUAL CAPACITY.

 

Jury Trial Waiver. TO THE EXTENT ANY CLAIM IS ADJUDICATED IN COURT, YOU AND PAWSIBLY YOURS WAIVE THE RIGHT TO A JURY TRIAL.

Governing Law. These Terms are governed by the laws of the State of Missouri, without regard to its conflict of laws principles. Any court proceedings permitted under these Terms will be brought in the state or federal courts located in Missouri.

  • 16. General Provisions

Entire Agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Pawsibly Yours, LLC with respect to the Services and supersede all prior agreements and understandings relating to the subject matter hereof.

Severability. If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

No Waiver. Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision.

Assignment. You may not assign your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations without restriction.
